Criminal Penalties [Utah Code - Title 41 - Chapter 06a]

A first or second DUI is typically a Class B misdemeanor, but may be elevated to a Class A misdemeanor if aggravating factors are present. A third DUI offense may be charged as a felony if it is within 10 years of your first DUI conviction.

DUI consequences include:

•First DUI: 48 hour minimum jail sentence; or 48 hours work service; or electronic home monitoring. Additional penalties for a first time DUI may include probation, education classes, treatment, placement of an interlock ignition system in your car, court fines and other penalties.

•Second DUI: 240 hour minimum jail sentence; or 240 hours work service; or electronic home monitoring. Additional penalties as indicated above.

•Third DUI: 0-5 year prison sentence; or a 1,500 hour minimum jail sentence. Additional penalties as indicated above.

Whether this is your first DUI or your third or higher DUI, the experienced criminal defense attorneys at Wasatch Advocates can provide the aggressive defense you need. In addition to seeking a not guilty verdict or charge dismissal on your behalf, we can negotiate directly with the prosecution to seek a plea agreement that will minimize your exposure to adverse consequences. We are mindful of your record, your rights, your driving privileges and your freedom. Contact Wasatch Advocates today to schedule a free consultation.
