When you drive under the influence of alcohol, the police will give you a breathalyzer test to determine if you had a blood alcohol content (BAC) over .08. However, while a .08 BAC establishes alcohol intoxication, there is no similar bright-line standard for when a person is illegally impaired by drugs.
As a result, the prosecution will rely on testimony from the arresting officer to establish that you were too impaired by drugs to safely operate a vehicle. The officer will rely on a variety of evidence including any admissions you may have made, evidence of slurred speech, and a failure to perform well on Field Sobriety Tests.
