Utah Underage DUI Laws are Tough
Utah DUI laws are very strict on drivers under the age of 21. When a driver is 21 or older, the state must prove that the driver had a BAC over .08, or was so intoxicated that they were incapable of operating a motor vehicle safely. Since it is difficult to prove the latter, the state typically must rely on evidence from a breathalyzer test to determine that the driver was above a .08 BAC level.
In a case involving a driver under the age of 21, however, the state only has to show that the driver had alcohol in their system. Any amount of alcohol could result in a conviction for underage DUI.
